For a contract to be valid, the consent of the parties must be genuine. The parties to the contract must have the same understanding of the subject matter of the contract. Consent alone is not sufficient to enforce a contract, consent must be free and voluntary. Free consent under Indian Contract Law is defined as consent free from compulsion, excessive influence, fraud, misrepresentation or misconduct. When these factors influence consent, it is questionable whether the consent given is free and voluntary. The purpose of this policy is to ensure that the decision of the parties is not ambiguous when agreeing. Therefore, there is a possibility of termination of the consent agreement granted under coercion, undue influence, fraud, misrepresentation or misrepresentation.
