Caveat emptor means ‘CAUTION BUYER’, in Latin term meaning “let the buyer beware”. It means that buyer should be extra careful in a contract of sale. And checking the goods carefully while purchasing is a main responsibility of the buyer. If a buyer purchases the goods and after some time if he comes to know that the goods is defective. Then in such case seller will not be responsible for this defect. Since seller is under no circumstances and responsibility to reveal any condition and truths of the goods sold and therefore, whenever the buyer buys goods, he must ensure and exercise necessary care in his own interest. A buyer, in contract of sale of goods, purchases the goods at his own risk. In the olden days the principle of ‘Caveat emptor’, which meant buyer beware governed the relationship between seller and the buyer. In the era of open markets buyer and seller came face to face, seller exhibited his goods, and buyer thoroughly examined them and then purchased them.
